1. Acceptance

By accessing StayBooked, submitting an intake request form, creating a contractor account, or ordering leads or property intelligence from the StayBooked platform, you agree to these Terms of Service. If you do not agree, do not use the service.

2. What StayBooked Is

StayBooked, an operating company of Solstate LLC, operates a dual-engine technology platform providing (a) high-intent, AI-qualified confirmed trade appointments (Pay-Per-Appointment) and (b) proprietary public property distress, permitting, and municipal citation intelligence feeds (Pay-Per-Lead). StayBooked is a marketing, data intelligence, and lead-referral technology provider — we are not a licensed construction contractor, trade provider, or healthcare facility, and we are not a party to any contract, agreement, or transaction entered into between participating consumers and contractors.

3. Proprietary Data Sourcing & Intellectual Property

StayBooked compiles property records, open permits, code violation citations, weather radar damage swaths, and commercial registry intelligence from a combination of public municipal repositories, government open data portals, real estate directories, and proprietary algorithmic signals. StayBooked retains all proprietary rights to its algorithms, data normalization schemas, scoring matrices, and aggregation methods. StayBooked is not obligated to disclose specific private data vendors, municipal APIs, or scraping pipelines.

4. Terms for Purchasing Contractors & Service Providers

Participating contractors and commercial buyers agree to the following operational standards:

• Pay-Per-Appointment (PPA) Model: You pay exclusively for confirmed appointments delivered to your dashboard or SMS — verified by AI/phone with confirmed homeowner intent and a scheduled calendar time window.
• Pay-Per-Lead (PPL) Model: You receive real-time, verified, consented homeowner project inquiries submitted directly through our digital acquisition campaigns, routed exclusively to your business according to trade and geographic coverage.
• Property Intelligence Feeds: Raw property distress records, municipal citations, code violations, and unassigned permits are provided strictly as informational public property intelligence for research, direct mail, and manual outreach. Public property records are not consented inbound leads and carry no appointment promise.
• 100% Replacement Guarantee: If a delivered PPA appointment turns out to be an unreachable number, a false homeowner, or out of your agreed service area, notify us within 48 hours for an instant 1-tap credit replacement.
• Independent Operator & TCPA/DNC Warranty: Purchasing contractors are independent commercial operators. Contractor agrees to conduct all subsequent marketing, direct mail, phone calls, or visits in strict compliance with all applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), and National Do-Not-Call (DNC) Registry requirements.
• Exclusivity: Confirmed appointments delivered to your account are routed exclusively to your business for that service order and are never dual-sold to competing contractors.

5. Consent to be Contacted (Homeowners & Consumers)

By submitting an estimate request form on any StayBooked landing page or partner widget with the consent checkbox selected, you provide prior express written consent to receive informational and marketing calls and text messages, including automated voice calls and AI-generated messages, from StayBooked and its verified local trade partners regarding your request. Consent is not a condition of purchasing any goods or services. Standard message and data rates may apply. You may revoke consent at any time by replying STOP to any text message or notifying our calling assistant. Additional information is available in our Privacy Policy.

6. No Guarantee of Contractor Work or Pricing

StayBooked connects property owners with independent trade professionals but does not perform, control, supervise, or warranty any construction, roofing, HVAC, plumbing, or electrical work. Any contract, estimate, warranty, or dispute concerning physical work performed is strictly between the homeowner and the independent contractor.

7. Disclaimers & Limitation of Liability

The platform and public data feeds are provided on an "as is" and "as available" basis without warranties of any kind. To the maximum extent permitted by applicable law, StayBooked and Solstate LLC shall not be liable for indirect, incidental, punitive, or consequential damages resulting from the use of the platform, lead data, or third-party contractor interactions.
